Standard Terms and Conditions of Trading
These terms form the basis of the contract between our customer and Great Cakiness Ltd. These Terms, your Order and your Order confirmation are considered by us to set out the whole agreement between you and us for the sale of cakes. It is your responsibility to check all details in the order confirmation are complete and accurate as this is the document we work to when completing your order.
Basis of Sale
Any samples, drawings, or descriptions we issue and any descriptions or illustrations contained on our website are issued solely to provide you with an approximate idea of the cakes they describe and remain the property of Great Cakiness Ltd.
Quotations are valid for a period of 30 calendar days from the day of issue. Cake sizes quoted are in inches and are based on the diameter of the cake. Cakes are 3 1/2 to 4 inches deep as standard. If you would like a deeper cake this needs to be requested at the time of booking and an additional cost will be incurred.
No contract is made with you until we have received your booking fee. Once your booking fee has been received you are in a legally binding contract with Great Cakiness Ltd.
We warrant that on delivery or collection the Cakes shall conform to their description as set out in the Order Confirmation, be of satisfactory quality and comply with all food safety, statutory and regulatory requirements in the UK. We will not be held responsible for customer disappointment of the design or the interpretation of the cake as long as it is made in line with the customer’s pre-agreed requirements set out in the order confirmation and will face no consequent liability. It is the customer’s responsibility to ensure all details within the order confirmation and sketch are correct and meet their exact requirements.
The warranty does not apply to any defect in the Cakes arising from wilful damage, accident, negligence by you or any third party if you use the cake in a way we do not recommend, your failure to follow our instructions or any alterations you carry out.
Our cakes are made in an environment where nuts, egg, milk, gluten and other allergens are present. We cannot guarantee that any cake is entirely nut-free although we make every effort to ensure that allergies are accommodated.
We cannot guarantee an exact replica of any cake but we will do our best to make it so. Where colour swatches are provided we will do our best to match as close as we deem possible. Exact colour matches are not guaranteed.
Your cakes should be stored in a cool dark place, preferably in the box supplied and not put into the fridge. Generally, vanilla, chocolate & lemon sponge will keep for up to 5 days after delivery, if they don’t get eaten! Fruit cake lasts for several months as long as it is wrapped up well. All of the ingredients are of the highest quality and some fruit cakes may contain nuts, traces of nuts or nut oil. Fruit cakes will be covered in marzipan and then sugar paste. Sugar paste is not designed to be refrigerated and should also be stored in a cool dark and dry place. If fresh flowers are required on any cake we can liaise with your florist as some flowers can be poisonous and will not be used. For all other flowers we can use clear acetate to rest the flowers on the cake. We usually make our vanilla extract so you may find larger pieces of vanilla in the sponge or buttercream, these are edible.
Fresh flowers are not included in the price of any wedding cake design. If a wedding cake is to be dressed with fresh flowers these are to be provided by your florist. NB. Please note some flowers are not suitable for use as a cake decoration. Ask your florist for details regarding toxicity. We cannot be liable for any contamination to our food product that may arise from their misuse. We recommend that your florist lease directly with us to confirm detail about the size of cake being dressed to avoid any miscommunication.
From time to time certain materials for our cakes may become obsolete. This is totally out of our control; however, we will do our best to select replacement products to reflect the original design as closely as possible. We reserve the right to replace items with component parts of equal or better quality without consultation.
If your cake contains figures made from sugar paste, whilst edible, we do not advise that they are eaten, due to the possible presence of dowels for reinforcement. All of our figures are handmade, and therefore, whilst we try to capture the characteristics of a particular person if requested (such as with eye colour, hair colour, hair length, glasses etc), we cannot guarantee a true likeness. It is your responsibility to provide images for our reference. If images are not provided standard figures shall be used.
Stacked cakes contain dowels in each tier to provide support and these should be removed before consumption.
The cake is a fresh product containing no additives or preservatives and it is our right to assume consumption on the day requested. Cakes should be stored in a dry place, at room temperature, away from direct sunlight and sources of heat in the box provided. They should NOT be refrigerated.
Great Cakiness Ltd and the customer expressly agree that the cakes and all goods purchased from Great Cakiness Ltd remain the property of Great Cakiness Ltd until paid for in full.
For celebration cakes, we require a minimum of 3 weeks notice however last minute orders may be accommodated where possible. Any cake ordered from a picture or photo of a cake produced by any other cake maker can only be reproduced as our interpretation and not an exact copy. For wedding cakes we require a minimum of 3 months notice however a shorter period may apply if we have availability – please contact us to check for availability. Following your consultation, your deposit will secure your date and then you will receive your sketch. For weddings, we do not accept more than 1 cake for the day. That way you can be assured of our highest attention on your special day. For cupcake orders, we require a minimum of 2 weeks notice or more depending upon the quantity. Please remember, if it is a special occasion you are advised to order as soon as possible.
Delivery and Collection
All orders may be collected free of charge from Great Cakiness Ltd by prior arrangement. We accept no responsibility for any damage sustained to the cake once it has left the premises.
If delivery has been requested we will deliver the cake on the day set out in the order confirmation to the address provided.
When delivering to a wedding venue, we will contact the venue in advance to arrange a mutually convenient time for delivery. If we set up the wedding cake we shall take a photograph of the cake before leaving and, where possible, obtain a signature from the venue confirming the cake has been received in good condition. Should the venue need to set up the cake themselves we shall explain how the cake is to be displayed and where possible obtain a signature to verify we have done so. Once the cake has been delivered we are unable to accept liability for any damage sustained to the cake thereafter nor any failure to follow the instructions provided.
Our delivery charge rate is £0.50p per mile round trip from BR1 5DB and back (minimum charge £10.00) applies. All cakes are delivered boxed and the boxes will be left for you at the venue if required.
If the cake is delivered with a stand, a security deposit will be payable with the final balance. The stand must be returned to us in a good, clean condition within 3 days of the wedding. Upon the return of the stand, the deposit will be refunded.
In the extremely unlikely event of any complaint, Great Cakiness Cake Design will only be liable to the maximum of a full refund of the order.
Deposits/Booking Fee & Final Payments
We require a deposit/Booking fee on the placement of all orders for cakes, which is deducted from the final balance payable. Deposits/Booking fees are non-refundable.
For celebration cakes under £100 a deposit/Booking fee of £40 is required, and for celebration cakes over £100, a 50% deposit/booking fee is required. By paying the deposit/Booking fee this secures your date. All final balances need to be paid by the date shown on the proposal form. If a celebration cake is ordered within the 3 weeks notice period then immediate payment is required.
For Wedding Cakes, a detailed order confirmation will be issued detailing the final balance and payment details.
For wedding cakes, a non-refundable booking fee/deposit of £75 is required which will secure your date. 50% of the remaining balance is then due 3 months prior to your date with the final outstanding balance being due for payment 1 month before the wedding date. (All of these dates will be on the order confirmation) If any monies are outstanding after this time then we will not be able to proceed with your order until full payment is made. If a wedding cake is ordered within the 3 months notice period then a non-refundable booking fee/ deposit of 75% is required with the final outstanding balance being due for payment 1 month before the wedding date. If an order is taken within the 1 month period before the wedding date then full payment is required. Please note when paying your booking fee/deposit for your cake it is believed that you have read, understood and accept our terms and conditions. As we only take one wedding cake per date the booking fee is non-refundable as we will turn away business if an order is already booked.
In the event of a cancellation, your booking fee/deposit is non-refundable. For all bookings other than weddings if a cancellation is received you will be liable to pay for any special order items and for any work that has been started. If the order is cancelled within 2 weeks of the collection/delivery date then all payments made are non-refundable. For wedding cakes, if a cancellation is received you will be liable to pay for any special order items and for any work that has been started. If the order is cancelled within the 1 month before the wedding date then all payments made are non-refundable.
In the event of a postponement, the payment due remains the same as a cancellation. Subject to availability we will carry the monies paid forward to the new wedding date. Please be aware that we will only do this on one occasion. Any further postponements will be classed as a cancellation.
You may, prior to 8 weeks before the wedding day, or 7 days for celebration cakes, amend or cancel your order by providing us with written notice. In the case of alterations, a new order confirmation will be issued detailing the changes and the new cost. Alterations are not confirmed until a new order confirmation has been issued.
In the unlikely event that we need to cancel your order, any monies paid will be refunded. Great Cakiness Ltd reserves the right to cancel, vary or suspend the operation of this contract if events occur which are in the nature of force majeure including (without prejudice to the generality of the foregoing): fire, floods, storm, plant breakdown, strike, lockouts, riot, hostilities, non-availability of materials or supplies or any other event outside the control of Great Cakiness Ltd, and Great Cakiness Ltd shall not be liable for any breach of contract resulting from such an event.
Great Cakiness. Ltd shall not under any circumstances be liable for the customer in respect of indirect consequential loss or damage or loss of profits, provided always that these conditions do not exclude or restrict Great Cakiness’s statutory liability for death or personal injury arising from any negligence on Great Cakiness’s part or liability imposed by statutory implied terms in Consumer Contracts.
Hired equipment & returning
Stands and other equipment are available for you to hire and must be returned to BR1 5DB within 3 days of the wedding date (unless alternative arrangements have been made prior to the wedding). A refundable deposit is required to guarantee the safe return of items although many venues can supply stands and a knife with their packages. Failure to return items within the specified time, or at all may incur extra charges. The refundable deposit will be returned once the hired equipment is returned in satisfactory condition.
In the unlikely event that Great Cakiness Cake Design is unable to complete your order due to unforeseeable circumstances, we will pass your order onto a 3rd party with your full knowledge for completion. A 3rd party will be chosen who is of the same technical skill to undertake your order.
Complaints are very rare and due to the amount of work put into each individual cake, we take them very seriously.
Both Parties agree to not post any negative information about the other arising out of this Contract or Event on any online forum or website without providing advance written notice of the intended content thereof and providing the other party with a prior opportunity to resolve any issues between the parties amicably.
Complaints regarding the decoration of celebration cake can be easily repaired so errors of this nature must be pointed out upon delivery/collection so as to give us the opportunity to correct them. Once payment has been handed over this confirms that decoration is as requested and no further claims can be made. Wedding cake clients will be sent a detailed sketch of their wedding cake prior to the wedding. It is the client’s responsibility to check that this meets with their requirements and raise any issues with us if there are any discrepancies.
Where the complaint is in regards to the quality of the cake then the cake, or remainder of the cake/tier, must be returned to us as soon as possible after cutting and within 48 hours of collection/delivery to ensure that we are able to fairly assess the nature of the complaint.
Please note we can only deal with the client who placed the original order.
All designs and intellectual property rights remain the property of Great Cakiness Ltd.
We reserve the right to use images of your cake for any form of advertising including web-based promotions, brochures, galleries and competitions. It is advisable that you make a copy of all documentation received from Great Cakiness Ltd for your own benefit.
This Agreement together with Order Confirmation documents provided constitutes the entire agreement and understanding between the parties relating to the order. Except as may be expressly stated in this Agreement, it supersedes and cancels all prior agreements, statements, representations, understandings, negotiations and discussions, whether oral or written, between the parties. Each of the parties acknowledges and agrees that in entering into this Agreement it does not rely on any statement, representation, warranty or understanding made prior to this Agreement save to the extent that such statement, representation, warranty or understanding is incorporated into this Agreement. Each of the parties acknowledges and agrees that in entering into this Agreement it has not relied on (or has been induced to enter into this Agreement by) any statement, representation, warranty or understanding made prior to this Agreement. Nothing in this paragraph excludes any liability for fraudulent misrepresentation.
In the event that anyone or more such provisions of this Agreement should be deemed to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity and enforceability of the remaining valid and enforceable provisions thereof which shall be construed as if such invalid or unenforceable provisions had not been inserted.
The parties agree to submit to the non-exclusive jurisdiction of the English courts.
Any headings utilised in this Agreement have been inserted for the convenience of reference only and should in no way restrict or otherwise affect the construction of the terms and conditions hereof.
Cake Decorating Courses
Attending a Class
To book a place at one of our classes, please contact us via email at [email protected] or call us for a chat on 07804 483681. All details required to attend a class will be emailed to you and once payment is received confirmation will be sent.
Payment can be made via bank transfer or cash. Gift Vouchers can also be purchased for any of our classes. All payments must be made in advance as no payment is accepted on the day.
Once you have reserved your place and made a payment, we do not offer a refund if you cannot attend. You may send someone else in your place. As our classes have a maximum number of spaces any cancellations may leave us in a difficult position as we may be unlikely to re-sell the space. If we have to cancel the class we will offer you an alternative date for the same class. If for any reason we cannot reschedule that class we will offer you a refund in full to the value of the class you paid for.
Every care has been taken to ensure the descriptions and photographs on our website accurately represent the quality of our work, and what you can expect from each class.
Gift Vouchers can be purchased by directly contacting [email protected] once payment has cleared then the voucher will be posted to you. Gift Vouchers are non-refundable, but we are happy for you to transfer them to another person if you contact us and arrange this at least 1 month in advance of any class you wish to attend. Purchasing a voucher doesn’t guarantee the recipient to a place in any of our classes. Please contact us first to confirm availability for your chosen course. Please note that gift vouchers are only redeemable against courses.
Photography & video
We may occasionally take photos during our courses for promotional material which would include the participants and the cakes produced. If you do not wish to have your photo taken or appear then please let us know.
During each class, we teach a number of skills & techniques that you can apply to your own cakes after the class. However, if you intend to run a cake decorating class, you may not use the designs or any notes, formats or photos acquired during one of our classes.
